Legal Interpretation: the role of the legal interpreter

Legal Interpreting can encompass any matter of law. It does it necessarily take place in court, as in ‘court interpreting’, but nonetheless requires the same high level level accuracy to ensure that all parties concerned can understand the important information at hand. Legal Interpreting then, may cover deposition, dispute resolution, arbitration and mediation.

As well being fluent and articulate in both languages in question, it is important that legal interpreters are knowledgeable about procedures of court and the laws under which the court is acting. Also beneficial is for the legal interpreter to have a background in the legal area at hand. A familiarity with the legal language being employed and the procedures

Dispute resolution, or alternative dispute resolution as it sometimes referred to, is a method of resolving disputes between parties without the need to go to court, saving time and money. Dispute resolution can refer to a number of techniques such as arbitration, mediation and conciliation. Arbitration uses a third party arbitrator to review the cases put forward by both parties and then decides on a legally binding resolution, as opposed mediation in which a third party is still used in the resolution process, but in this case to help the two parties find their own settlement. Conciliation a more indirect process  of resolution where by the third party conciliator will go between the two parties, meeting separately, with the aim of improving relations, finding solutions to issues and conveying concerns with aim bringing about a negotiated settlement. Dispute resolution techniques can occur between individuals, businesses or even nation states.

At other times, multi-lingual legal specialists are vital for ensuring parties fully understand an agreement before they commit to it. These contract negotiations are increasingly valued as multi-national companies agree to work with one another, yet do not share a language. Here, the legal language skills of the contract interpreter help bring a successful, workable solution to negotiations that hopefully will ensure against later dispute. However, if the terms of the contract should be breached, or some matter arise regarding its wording, then contract translation maybe required either as part of ADR or during a court process.
